Terms of Service

1. Introduction

Welcome to Therapy Europe. These Terms of Service ("Terms") govern your use of our website and services located at therapyeurope.com (the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

Therapy Europe operates as a marketplace connecting clients with independent mental health professionals, including therapists, psychologists, and certified coaches ("Experts"). We do not provide mental health services directly.

2. Eligibility

To use our Platform, you must be:

  • At least 18 years of age, or the age of majority in your jurisdiction
  • Capable of entering into a legally binding agreement
  • Located in a country where our services are available

If you are under 18, you may only use the Platform with the involvement and consent of a parent or legal guardian.

3. Account Registration

To book sessions or offer services as an Expert, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. The Marketplace Model

Therapy Europe operates as a marketplace platform:

  • Platform Fee: We charge a 30% platform fee on each transaction
  • Expert Payment: 70% of the session fee goes directly to the Expert
  • Independent Contractors: Experts are independent professionals, not employees of Therapy Europe
  • Direct Relationship: The therapeutic or coaching relationship is directly between you and the Expert

5. Expert Verification

We require all Experts to:

  • Provide proof of professional qualifications and licenses
  • Maintain appropriate professional insurance
  • Adhere to their professional code of ethics
  • Complete our verification process

While we verify credentials, we do not guarantee the quality, suitability, or outcomes of services provided by Experts.

6. Booking and Payments

When booking a session:

  • Payment is processed securely through our payment provider (Stripe)
  • Full payment is required at the time of booking
  • Experts set their own rates and availability
  • Prices are displayed inclusive of the platform fee

7. Cancellation and Refunds

Our cancellation policy:

  • 24+ hours notice: Full refund available
  • Less than 24 hours: 50% refund at Expert's discretion
  • No-show: No refund
  • Expert cancellation: Full refund and priority rebooking

Refunds are processed within 5-10 business days to the original payment method.

8. User Conduct

You agree not to:

  • Provide false or misleading information
  • Harass, abuse, or harm other users or Experts
  • Use the Platform for any illegal purpose
  • Attempt to circumvent our payment system
  • Violate the intellectual property rights of others
  • Interfere with the proper functioning of the Platform

9. Important Disclaimers

Not Emergency Services: Therapy Europe is not a crisis service. If you are experiencing a medical or mental health emergency, please contact your local emergency services immediately.

No Medical Advice: Information on our Platform is for general informational purposes only and should not be considered medical or professional advice.

Results Not Guaranteed: We cannot guarantee specific outcomes from therapy or coaching sessions.

10. Limitation of Liability

To the maximum extent permitted by law, Therapy Europe and its affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Actions or advice provided by Experts
  • Technical issues or service interruptions
  • Unauthorized access to your account

Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

11. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of Therapy Europe or its licensors and is protected by intellectual property laws.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the Netherlands, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation through an EU-approved alternative dispute resolution provider
  3. If necessary, binding arbitration or courts of competent jurisdiction in the Netherlands

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the new Terms.
